Customer acknowledges and agrees that All Auto Trust Transport, LLC is a broker that has agreed to arrange a third party carrier to transport Customer’s vehicle. Customer acknowledges and agrees that All Auto Trust Transport, LLC and the selected carrier are independent parties with no affiliation.
Customer warrants that it is the registered legal owner of the vehicle, or that it has been authorized by the legal owner(s) to enter into this agreement for transportation of the vehicle. Customer hereby authorizes the carrier selected by All Auto Trust Transport, LLC to operate and transport the vehicle from point of origin to the destination specified in the quote. Moreover, Customer authorizes the carrier to drive said vehicle either at origin or destination between the points of loading/unloading and the points of pickup/delivery, and Customer shall provide insurance for same.
All Auto Trust Transport, LLC does not agree to transport the vehicle on any particular truck, nor in time for any particular event, due to possible delays outsider of Auto Trust Transport, LLC’s control, including but not limited to weather, road conditions, mechanical problems, etc. All Auto Trust Transport, LLC shall use its best efforts to pick up and deliver the vehicle within the estimated time frame; however, because unforeseeable factors could delay delivery beyond the estimated time frame, All Auto Trust Transport, LLC does not guarantee the date or time of pick up or delivery.
All Auto Trust Transport, LLC has up to 15 days from the first available pick up date to assign a driver to your order. You may cancel your order prior to the carrier taking possession of your vehicle but you will be subject to a $90 administration fee that will be withdrawn from your deposit. Cancellation requests must be done in writing and directed to _ALL AUTO TRUST TRANSPORT LLC. Placing an improper stop payment on a check or in connection with a credit card deposit will be considered a breach of this Agreement.
In case Customer is unavailable and/or unreachable on or 24 hours prior to the delivery scheduled date, storage and a redelivery charge will be assessed. Customer shall pay any and all costs, including storage, towing and additional delivery costs incurred as a result of Customer’s unavailability. All Auto Trust Transport, LLC does not agree to pay for your rental of a vehicle and auto rental accruals will not be honored.
Unless Customer pre-pays the delivery charge in full, Customer agrees to pay a deposit of the delivery charges made payable to All Auto Trust Transport, LLC for each vehicle when placing an order and the remaining balance, including any additional charges, is due COD at the pick up or delivery location in accordance with the quote in the form of cash or certified funds payable to the assigned carrier. Customer is aware that prices may vary due to carrier’s request. All Auto Trust Transport, LLC is not liable to pay carrier for difference between quote and charges due upon delivery. All Auto Trust Transport, LLC strives to price its quotes as accurate as possible, however it cannot guarantee that pricing will not change due to the carriers. In the event that cash or certified funds are not available at delivery the Customer shall be responsible for any and all storage fees assessed. In order to expedite pick up/delivery the Customer agrees to meet the carrier at a specified time and place if necessary.
If vehicle is inoperable or customized please inquire as to extra charges. Customers looking to transport trucks must notify All Auto Trust Transport, LLC as to the truck’s dimensions and whether it has oversized tires, extended cab, camper shell, toolbox, etc. If All Auto Trust Transport, LLC is not advised of inoperable, oversized, or customized vehicles prior to pick-up, all extra charges will be added to COD charges at time of delivery. Such charges are at the discretion of the carrier.
Trucking damage claims are covered by the carrier from $100,000.00 up to $250,000.00 cargo insurance per load for Open Carriers and fully insured for enclosed Carriers.
Customer is responsible for preparing the vehicle for transport. Vehicle(s) must be rendered to carrier in good running condition with no more than a quarter tank of fuel. All loose parts, fragile or protruding accessories, low hanging spoilers, antennas, etc. must be removed and properly secured. Security systems should be disarmed and any keys or transmitters for said device must be provided to the transporter. Any part of the vehicle that falls off during transport as well as any damages caused by said part to any and all other vehicles involved is the Customer’s responsibility.
Luggage and personal property must be confined to trunk, with no heavy articles, and not to exceed 100 lbs, and presence of such luggage is at carrier’s discretion. Electronics, electronic equipment, valuables, furniture, firearms, plants, live animals, drugs, chemicals, and alcohol are prohibited from being transported. Broker/carrier are not liable for personal items left in vehicle or for damage that they have caused. Any violation of such weight restriction could result in a fine that is at Customer’s expense and shall be collected at time of delivery.
All Auto Trust Transport, LLC warrants and Customer acknowledges that All Auto Trust Transport, LLC is licensed by the U.S Department of Transportation. Broker’s License # MC-679470.
Oversea transportation:
Vehicle must be completely empty, except for the factory installed equipment. Trunks are only allowed to contain the vehicles spare tire and factory car jack. Vehicle must not contain more than ∏ tank of gas, and all keys must accompany the car. All cars must be in good running condition. The price quote is base on cubic feet measurement, if they differ from the measurements given by the customer, any price difference must be paid prior to shipping. If vehicle needs to be stored at the port for any reason (i.e. improper paperwork, ownership, lack of payment etc) customer is liable for the fees. The price quote does not include storage fees, handling and custom duties at the overseas destination.
Customer agrees to properly note any claimed damage on the Bill of Lading while the carrier is making the delivery, and to pay the balance of the delivery charges in cash or a certified funds. Carrier, not All Auto Trust Transport, LLC, is responsible for any damage done to scheduled vehicle while in transit, barring any of the exceptions detailed in this contract or in carrier’s Bill of Lading. In order for the claim to be considered, such damage must be noted on carrier’s Bill of Lading at time of delivery. Any claim of damage must be filed with carrier within 15 days of delivery in writing, specifying the damage claimed, and must be accompanied by two written estimates of repair and photographs of the claimed damage. Customer agrees to file all claims with such carrier as identified on the Bill of Lading/delivery receipt, and to bring any legal action for damages against such carrier only. Customer agrees to release and hold harmless All Auto Trust Transport, LLC of any such claims. The carrier’s bill of lading at destination without notation of damage shall be evidence of satisfactory and damage-free delivery of the vehicle.
Due to varying circumstances, i.e. D.O.T. weight restrictions, steep hills, overhanging branches, narrow/winding streets, cul-de-sacs, local municipal laws etc., the carrier on “door-to-door” shipment may have to arrange with Customer/designee to meet him/her at a legal or safe pick-up or drop-off point as close as possible to the specified delivery address, but at the Carrier’s discretion.
Broker/Carrier or any of their agents shall not be liable for the following: Damage caused by fluids, acids, cooling system antifreeze, industrial fallout or damage caused by an act of god. Damage, which is undetectable due to vehicle's condition or glass damage caused by normal wear and road use. Mechanical functions, operational functions, exhaust assembly, frame, alignment, tire damage, soft top convertibles, suspension, tuning of engine or damage that is a result of tie downs tearing or breaking. Auto rental accruals. The carrier’s responsibility for the described vehicle commences when the bill of lading is issued and signed by the driver and terminates when designated vehicle is signed for at destination. Damage resulting from overloaded vehicles. Damage due to any convertible tops that are loose, torn, or have visible wear, bras, or any other type of canvas or material covering. Damage to acts of god. Damage to Vehicles caused because: Vehicles cannot be driven on or off transporter under its own power. Vehicles have defective or insufficient brakes, parking brake or parking gear.
Customer agrees to indemnify, defend and hold All Auto Trust Transport, LLC and the carrier harmless for any costs, expenses, damage, losses and claims caused by Customer's breach of any warranty or obligation under this Agreement.
Customer upon tender of shipment to the carrier or its agent, and the consignee upon acceptance of delivery of shipment or its agent, shall be jointly and severally liable for any and all unpaid charges payable on account for shipment, including but not limited to, sums advanced or disbursed by All Auto Trust Transport, LLC or its agent on account of such shipment and any and all costs of collection including costs and reasonable attorneys fees.
Customer agrees to indemnify, defend and hold All Auto Trust Transport, LLC harmless for any costs, expenses, damage, losses and claims arising out of or caused by Customer’s breach of any representations, warranties or obligations under agreement.
Any and all suits must be carried out in the state of Florida. In the event of any legal proceedings brought in connection with this Agreement, the prevailing party shall be entitled to receive from the non-prevailing party and the non-prevailing party shall pay upon demand all reasonable fees and costs of counsel for the prevailing party.
This agreement supersedes all prior written and oral representation of All Auto Trust Transport and constitutes the entire Agreement between Customer and All Auto Trust Transport and may not be changed except in writing signed by an authorized officer of All Auto Trust Transport.
